Confidentiality Commitment

The form is designed to be anonymous. Whether or not you choose to voluntarily provide your name when completing the form, Distalmotion is committed to protecting the identity of all individuals who use its reporting system as well as all individuals who may be named in the report. However, while Distalmotion will not disclose your identity without your express permission, it is possible that your identity may be indirectly discovered during the investigation based on the information you provide.

Incident Description

Accounting, Auditing, and internal financial controls: Questionable procedures relating to accounting, auditing, or financial controls. Examples include misstatement of financial reports, violations of generally accepted accounting principles, billing issues, information security, and financial concerns.

Anti-Trust: questionable practices which result in conspiring to reduce fair competition. Example include price fixing, bid riffing, market allocation, monopolization etc.

Bribery and Corruption: Direct or indirect participation in any bribes, kickbacks, illegal gratuities or improper inducements or payments to any customer, business partner, consultants, supplier and/or government official.

Compliance and Regulation Violation: Violations of a rule, regulation, law, operating procedure, practice or protocol.

Conflict of Interest: Actions that influence the exercise of one’s duty of loyalty. Examples include inappropriate vendor relations, bribery, and exploitation of confidential information.

Discrimination: The denial of privileges or rights to individuals based on their race, color, ancestry, ethnicity, gender (sex), age, religion, origin, level of education, political affiliation, physical appearance, disability, marital status, or sexual orientation.

Employee relations: Issues related to the way employees work with each other; their supervisors/managers; and the company. Issues include promotions, job or shift changes, terminations, disciplinary actions and performance.

Falsification of Records: Altering, fabricating, destroying, misrepresenting, or forging contracts or documents for personal gain.

Fraud: A willful or deliberate act committed with the intention of obtaining money from any government programs through misrepresentation, deception, or other unethical means.

HIPPA: Violation of security and privacy of patients' medical records and other health information.

Harassment: Unwanted verbal or physical behavior of an inappropriate nature.

Improper Giving or Receiving of Gifts: Giving, receiving or solicitation of valuables which could be interpreted as an effort to influence a business relationship or decision.

IT Security: Violations of information security policies, code of computer conduct that govern conduct while using the network or confidential information resources.

Data Breach: A security incident that results in the unauthorized access, disclosure, alteration, or destruction of personal data. It occurs when sensitive information, such as names, addresses, or financial details, is compromised, potentially leading to risks like identity theft, fraud, or privacy violations.

Retaliation: Statements, conduct or actions discharging, demoting, suspending, threatening, harassing or discriminating against an employee because of any lawful act taken by such employee in connection with reporting a violation of law or Company policy, filing a complaint, or assisting with an investigation.

Safety Concerns: Conditions that compromise the health, safety, and well-being of employees, customers, vendors, or visitors. Sexual Harassment: Unwanted and offensive sexual advances or sexually offensive remarks or acts. Examples may include unwanted conversation, obscene gestures, comments, jokes, touching, staring/leering or whistling.
